Terms of Service

1. Agreement

By creating an account or using hustler.co.za ("the Platform"), operated by Tapnet Solutions (Pty) Ltd ("Tapnet", "we", "us"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Platform. You must be at least 18 years old to use this Platform. These Terms apply to hustler.co.za and all other websites, applications, and digital services operated by Tapnet Solutions (Pty) Ltd.

2. The Platform

Hustler provides tools for side hustlers and freelancers to create professional profiles, list services, generate quotes/invoices, and connect with clients. We are not a party to any transaction between hustlers and clients. We do not guarantee any outcomes, employment, or income.

3. Accounts

  • You must provide accurate information when creating your account
  • You are responsible for maintaining the security of your account credentials
  • You may not create accounts for others, impersonate others, or use misleading information
  • One person may have one account only
  • We may suspend or terminate accounts that violate these Terms

4. User Content

You retain ownership of all content you create (profiles, service listings, quotes, invoices). By posting content, you grant us a non-exclusive, worldwide licence to display, distribute, and store it for the purpose of operating the Platform. You are responsible for ensuring your content:

  • Does not infringe any third-party intellectual property rights
  • Is not false, misleading, defamatory, or illegal
  • Does not contain harmful, abusive, or discriminatory material
  • Does not include malware, spam, or phishing attempts

We may remove content that violates these Terms without notice.

5. Subscriptions and Payments

  • The Free plan is free forever with limited features
  • The Pro plan costs R97/month, billed via PayFast
  • Subscriptions auto-renew monthly until cancelled
  • You may cancel at any time from your dashboard; access continues until the end of the billing period
  • We do not offer refunds for partial billing periods
  • We reserve the right to change pricing with 30 days' notice

6. Hustler-Client Transactions

Hustler facilitates connections between hustlers and clients but is not a party to any agreement, transaction, or dispute between them. We do not:

  • Handle payments between hustlers and clients
  • Guarantee the quality of services provided
  • Mediate disputes between parties
  • Employ or contract hustlers

7. Prohibited Use

You may not:

  • Use the Platform for illegal activities
  • Scrape, crawl, or harvest data from the Platform
  • Attempt to hack, disrupt, or overload the Platform
  • Create fake profiles or misleading content
  • Use the Platform to send unsolicited marketing (spam)
  • Circumvent security measures or rate limits

8. Limitation of Liability

To the maximum extent permitted by South African law:

  • The Platform is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the 12 months preceding the claim
  • We are not liable for losses arising from hustler-client interactions

9. Privacy

Your use of the Platform is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with POPIA.

10. Intellectual Property

The Hustler name, logo, design, and platform code are our intellectual property. You may not copy, modify, or distribute any part of the Platform without written permission.

11. Termination

  • You may delete your account at any time from Settings
  • We may terminate your account for violation of these Terms
  • Upon termination, your profile and public content will be removed
  • Financial records may be retained for 5 years as required by tax law

12. Governing Law

These Terms are governed by the laws of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.

13. Changes

We may update these Terms from time to time. Material changes will be communicated via email or platform notification. Continued use after notification constitutes acceptance.
